Georgetown University Constitutional Law Professor: "The Case For A Federalism Amendment"

Professor Barnett's piece in the Wall Street Journal points out that the constitution allows state legislatures petition Congress for a convention to propose amendments to the Constitution. Barnett says that "before becoming law, any amendments produced by such a convention would then need to be ratified by three-quarters of the states... State legislatures can petition Congress for a convention to propose a specific amendment. Congress can then avert a convention by proposing this amendment to the states, before the number of petitions reaches two-thirds." This is a very interesting constitutional mechanism being proposed by Barnett for states to respond to an unprecedented expansion of federal power.
