Justice David Souter (Also Known As George H. W. Bush's Greatest Mistake) To Retire From Supreme Court

I think this is an important to remind some people out there what Obama himself has said about judicial appointments. First, Obama voted against Justice Samuel Alito. In 2006 he did so because he was "deeply troubled" by Alito's "philosophy, ideology, and record." So if there are Senators that oppose Obama's future nominee, I would not be surprised if Obama suddenly takes a very different tone.
In 2001, Obama said in a radio interview that he wished the country could achieve "redistributive change" through the courts. He also talks about the court breaking "free from the essential contstraints that were placed by the founding fathers in the constitution." I think this should give you some sense of what kind of Justice Obama would prefer.
It should come as no surprise that Obama has promised a replacement with lots of "empathy." Obama said that the "quality of empathy, of understanding and identifying with peoples hopes and struggles as an essential ingredient for arriving at just decisions and outcomes." In truth, empathy should take a back seat to constitutionality when a Supreme Court Justice makes a decision. The job of a Supreme Court Justice should be to uphold the law as enshrined in the document written by the Founding Fathers. Anything more, any decision based on "empathy" rather than what the Constitution actually says and was intended to say, is judicial activism.
In the end it will not matter who Obama appoints because Justice Souter has been a reliably liberal vote on the court. The philosophical tilt of the court will not change much no matter who the replacement is.

The "anti-torture" absolutist Jon Stewart is exposed as a nutbag when Cliff May asks if he would consider Harry Truman a war criminal for dropping the nuclear bomb on Japan and Stewart answers in the affirmative. Stewart said, "Here's what I think of the atom bombs. I think if you dropped an atom bomb fifteen miles offshore and you said, 'The next one's coming and hitting you,' then I would think it's okay. To drop it on a city, and kill a hundred thousand people. Yeah. I think that's criminal." The exchange takes place in part 2 of the debate.

CBS Radio Reporter Asks Obama If He Would Authorize Waterboarding If There Was An Imminent Threat?
Here you can watch Obama declare that waterboarding is "torture." Obama explained his position by saying he felt this way "not because there might not have been information that was yielded by these various detainees ... but because we could have gotten this information in other ways, in ways that were consistent with our values, in ways that were consistent with who we are." What "other ways" Obama has in mind that could have gotten information out of the likes of 9-11 mastermind Khaled Sheikh Mohammed is something upon which the president failed to elaborate.

FAA Memo: Feds Knew Low-Altitude NYC Flyover Would Cause Panic But Ordered It Be Kept Secret Anyway And Threatened Sanctions If It Was Revealed
CBS reports that "federal officials knew that sending two fighter jets and Air Force One to buzz ground zero and Lady Liberty might set off nightmarish fears of a 9/11 replay, but they still ordered the photo-op kept secret from the public. In a memo obtained by CBS 2 HD the Federal Aviation Administration's James Johnston said the agency was aware of 'the possibility of public concern regarding DOD (Department of Defense) aircraft flying at low altitudes' in an around New York City. But they demanded total secrecy from the NYPD, the Secret Service, the FBI and even the mayor's office and threatened federal sanctions if the secret got out... The flyover -- apparently ordered by the White House Office of Military Affairs so it would have souvenir photos of Air Force One with the Statue of Liberty in the background -- had President Obama seeing red. He ordered a probe and apologized."
In one sense, it's comforting to know that someone in the government realized what every half-wit would have found patently obvious, that a 747 flying at low altitude near the downtown Manhattan skyline would cause a terror scare. The government ordering it be kept secret and threatening federal sanctions is inexcusable. If anything, the government should have broadcast this flight as much as they possibly could so as to avoid any panic.
Another important question is why the governmnet, in an economic dowturn or even in an economic upturn, would waste taxpayer money flying empty planes around? Has the White House never heard of photoshop? Bloomberg.com reports that Air Force spokeswoman Vicki Stein said the flight cost taxpayers $328,835.
I also wonder if this kind of sheer stupidity had been shown by someone in the Bush administration whether the media would be covering this story differently?

CNN reports that "veteran Pennsylvania Sen. Arlen Specter told colleagues Tuesday that he switched from the Republican to the Democratic Party, Sen. Harry Reid says. The Specter party switch would give Democrats a filibuster-proof Senate majority of 60 seats if Al Franken holds his current lead in the disputed Minnesota Senate race. '"Since my election in 1980, as part of the Reagan Big Tent, the Republican Party has moved far to the right,' Specter said in a statement posted by his office on PoliticsPA.com. 'Last year, more than 200,000 Republicans in Pennsylvania changed their registration to become Democrats. I now find my political philosophy more in line with Democrats than Republicans.'"
“You have my full support," President Obama said, adding that he was "thrilled to have you.”
RNC Chairman Michael Steele responded to this news saying that "some in the Republican Party are happy about this. I am not. Let’s be honest-Senator Specter didn’t leave the GOP based on principles of any kind. He left to further his personal political interests because he knew that he was going to lose a Republican primary due to his left-wing voting record. Republicans look forward to beating Sen. Specter in 2010, assuming the Democrats don’t do it first." On the other hand, Senator Jim Demint said, “I would rather have 30 Republicans in the Senate who really believe in principles of limited government, free markets, free people, than to have 60 that don’t have a set of beliefs.”

Director Of The White House Military Office Sparks Terror Scare In New York City
The NY Post reports that "a jumbo jet being chased by a F-16 fighter jets buzzed Lower Manhattan this morning, panicking New Yorkers, many of whom were forced to evacuate their office buildings... [T]he low-flying 747 circling the Statue of Liberty was one of the planes used as Air Force One, sources said. The NYPD and the city were notified of the planned flight, but did not share that information with Mayor Bloomberg and other New Yorkers, many of whom said they were terrified. Dominick Caglioti, who works at the Mercantile Exchange, thought the worst as he saw the jets hurtle toward his window just after 10:30 a.m. After learning it was all a photo op, he was furious. 'It's so stupid because they tell you about every fire drill, but they didn't tell us about this,' he said. The planes flew over the Verrazano Bridge, buzzed the left ear Lady Liberty and then continued up the Hudson past Jersey City and then circling back toward Staten Island, federal sources told the Post. Thousands flooded the streets downtown as buildings called evacuations. 'There is situation outside. We don't have any further information,' went one announcement at the Embassy Suites downtown."
NBC news reports that "an official from the Obama administration said the White House Military Office wanted to update its file photo of the president's plane near the Statue of Liberty. This official, who spoke on the condition of anonymity, said the White House Military Office told the Federal Aviation Administration that it periodically updates file photos of Air Force One near national landmarks, like the statute in New York harbor and the Grand Canyon... 'Everybody panicked,' said Daisy Cooper, a Merrill Lynch worker in Jersey City, who lost a nephew on 9/11. 'Everybody was screaming and we all ran downstairs.
I'm devastated...Everybody was running, we didn't know why we were running. We just knew it was a plane, there we go, 9/11 again.'... A Pentagon official confirmed that while the Presidential Airlift Group, which is based out of Andrews Air Force Base, did inform the FAA and New York City officials about this morning's aerial photo op, they also told both agencies not to inform the public about it.The NYPD confirmed that statement. Louis Caldera, Director of the White House Military Office took the blame for the photo-op flap."

The United Arab Emirates And What Torture Really Looks Like
A Royal Sheikh from the United Arab Emirates is seen on tape mercilessly torturing a man with whips, electric cattle prods and wooden planks with protruding nails. "Get closer. Get closer. Get closer. Let his suffering show,” the sheikh says. The torturing Sheikh Issa bin Zayed Al Nahyan is the brother of Sheikh Mohammed bin Zayed Al Nahyan, crown prince of Abu Dhabi and deputy head of the UAE armed forces. He is also the half-brother of Sheikh Mansour bin Zayed Al Nahyan, who is a key political figure and member of the UAE federal Cabinet and minister of presidential affairs.
Rep. James McGovern (D-MA), said in a letter to Secretary of State Clinton that the tape "shocks the conscience" and demanded she "express the outrage of our nation regarding these acts, and call for an end to the impunity that has provided Sheikh Issa the freedom and license to carry out such heinous acts without the fear of legal reprisal or consequences." He has already called for a freeze on US aid to the UAE. The 45 minute-long tape also shows a man in a UAE police uniform tying the victim's arms and legs, and later holding him down as the Sheikh pours salt on the man's wounds and then drives over him with his Mercedes SUV.
The victim, a grain dealer, was apparently tortured over a missing load of grain worth about $5000.
In Issa's defense, at least nobody was waterboarded.
