The AP reports that according to two senior Israeli politicians the election of "Mahmoud Ahmadinejad underscores the growing threat posed by Tehran and its nuclear ambitions... "If we had an any shred of hope for change in Iran, the re-election of Ahmadinejad demonstrates the increasing Iranian threat," Deputy Foreign Minister Danny Ayalon said in a text message sent to news organizations. Obama Reverses Position He Held As Candidate And Has Justice Department Defend The "Defense Of Marriage Act" In Court
ABC's Jake Tapper reports that "President Obama’s Justice Department filed legal papers late Thursday to dismiss the first same sex marriage case filed in federal court. The Justice Department defended the Defense Of Marriage Act, or DOMA, which as a candidate then-Sen. Obama opposed, saying that the plaintiffs Arthur Smelt and Christopher Hammer are seeking a ruling on 'whether by virtue of their marital status they are constitutionally entitled to acknowledgment of their union by states that do not recognize same-sex marriage, and whether they are similarly entitled to certain federal benefits. Under the law binding on this Court, the answer to these questions must be no.'”
"The plaintiffs in this case, a same-sex couple married under the laws of California, make a number of claims against DOMA,” the Obama Justice Department lawyers argued. “Specifically, they allege that Section 2 violates the Full Faith and Credit Clause and their ‘right to travel,’ that both sections of DOMA violate the Due Process Clause of the Fifth Amendment (including its equal protection component) and their ‘right to privacy,' and that Section 3 violates their ‘right of free speech’ and their ‘rights’ under the Ninth Amendment. Plaintiffs initially filed this action in State court, and the defendant United States removed it to this Court. Rather than reaching the merits of these claims, the Court should dismiss this action for lack of subject matter jurisdiction."
Justice spokeswoman Tracy Schmaler said that President Obama “has said he wants to see a legislative repeal of the Defense of Marriage Act because it prevents LGBT (lesbian, gay, bisexual, transgender) couples from being granted equal rights and benefits," she said. "However, until Congress passes legislation repealing the law, the administration will continue to defend the statute when it is challenged in the justice system."
Jake Tapper further reports that "the Obama administration cited Catalano v. Catalano (marriage of uncle to niece, 'though valid in Italy under its laws, was not valid in Connecticut because it contravened the public policy of th[at] state'); Wilkins v. Zelichowski (marriage of 16-year-old female held invalid in New Jersey, regardless of validity in Indiana where performed, in light of N.J. policy reflected in statute permitting adult female to secure annulment of her underage marriage), and re Mortenson’s Estate, (marriage of first cousins held invalid in Arizona, though lawfully performed in New Mexico, given Arizona policy reflected in statute declaring such marriages 'prohibited and void').

Iranian State Media Declares Mahmoud Ahmadenijad Wins Iranian Election
Reuters reports that the Iranian "media declared President Mahmoud Ahmadinejad the winner of Iran's election but challenger Mirhossein Mousavi alleged irregularities and claimed victory for himself. The state election commission said early on Saturday that Ahmadinejad...was ahead with almost 68 percent of the vote after 15 million votes -- or 47 percent of ballot boxes -- had been counted. Mousavi, a moderate, had just over 30 percent. The official news agency IRNA said: 'Dr. Ahmadinejad, by winning most votes at the 10th presidential election, has secured his victory.'"

Innocent Man Jeffrey Deskovic Spends Six Years Behind Bars Because Of Sotomayor Decision
The New York Times reports that "Imprisoned at the age of 16 for the killing of a high school classmate, Mr. Deskovic, now 35, filed a habeas corpus petition in 1997 in Federal District Court contesting his conviction. The court denied the request because the paperwork had arrived four days late. Mr. Deskovic and one of his lawyers — who he said had been misinformed about the deadline for filing — appealed the decision to the federal appellate court on which Ms. Sotomayor sat. Ms. Sotomayor, along with the other judge on the panel, ruled that the lawyer’s mistake did not 'rise to the level of an extraordinary circumstance' that would compel them to forgive the delay. There was no need to look at the evidence that Mr. Deskovic insisted would affirm his innocence, they said. Mr. Deskovic spent six more years behind bars, until DNA found in the victim not only cleared him, but connected another man to the crime."

Was Holocaust Museum Shooter James Van Brunn Really "Right-Wing"?
Politico reports that "FBI agents visited the offices of the conservative Weekly Standard magazine yesterday after a shooting at the Holocaust Memorial Museum and told employees they'd found the magazine's address. A senior Standard staffer confirmed the visit but declined to discuss it in detail... The suggestion that the Standard may have been a target complicates any view of the racist shooter in contemporary left-right terms. Von Brunn's white supremacist roots put him under the rubric of a 'right-wing extremist,' but the substance of his views -- which included everything from believing that President Bush may have been in on the September 11 attacks to denying that President Obama is an American citizen -- are too far on the fringe to fit into conventional political classification. The focus on the Standard, though, appears to be of a piece with his central motivation: Anti-Semitism. In one essay, Von Brunn attacked 'JEWS-NEOCONS-BILL O’REILLY,' and the suggestion that neoconservatism is a specifically Jewish conspiracy is common on the racist fringe."
Further, WTTG/MyFoxDC reports that they were told by law enforcement sources "that during a search of a car that is believed to belong von Brunn, investigators found a notebook with information about six to nine locations in the D.C. area, including the National Holocaust Museum. Other locations on the list included the U.S. Capitol, the White House, the Washington Post, and a FOX News location."

Vote Could Bring New Federal Smoking Limits
The AP reports that "the Senate struck a historic blow against smoking in America Thursday, voting overwhelmingly to give regulators new power to limit nicotine in the cigarettes that kill nearly a half-million people a year, to drastically curtail ads that glorify tobacco and to ban flavored products aimed at spreading the habit to young people... The legislation, one of the most dramatic anti-smoking initiatives since the surgeon general's report, would give the Food and Drug Administration authority to regulate the content, marketing and advertising of cigarettes and other tobacco products."

Representative Mike Rogers: Obama Having Miranda Rights Read To Terrorists In Afghanistan
The Weekly Standard reports that "the Obama Justice Department has quietly ordered FBI agents to read Miranda rights to high value detainees captured and held at U.S. detention facilities in Afghanistan, according a senior Republican on the House Intelligence Committee. 'The administration has decided to change the focus to law enforcement. Here’s the problem. You have foreign fighters who are targeting US troops today – foreign fighters who go to another country to kill Americans. We capture them…and they’re reading them their rights – Mirandizing these foreign fighters,' says Representative Mike Rogers, who recently met with military, intelligence and law enforcement officials on a fact-finding trip to Afghanistan. Rogers, a former FBI special agent and U.S. Army officer, says the Obama administration has not briefed Congress on the new policy. 'I was a little surprised to find it taking place when I showed up because we hadn’t been briefed on it, I didn’t know about it. We’re still trying to get to the bottom of it, but it is clearly a part of this new global justice initiative.'”
“When they mirandize a suspect, the first thing they do is warn them that they have the 'right to remain silent,’” says Representative Pete Hoekstra, the ranking Republican on the House Intelligence Committee. “It would seem the last thing we want is Khalid Sheikh Mohammed or any other al-Qaeda terrorist to remain silent. Our focus should be on preventing the next attack, not giving radical jihadists a new tactic to resist interrogation--lawyering up.”

Gallup: More Americans Viewing Obama's Economic Plans Unfavorably
The latest Gallup poll found that despite the fact that "67% of Americans view President Barack Obama favorably, his overall job approval rating and his ratings on specific areas are less positive. At the low end of the spectrum, only 45%of Americans approve of Obama’s handling of federal spending, and 46% of his handling of the federal budget deficit... Obama’s job approval rating for his handling of the economy has dropped from 59% in February to 55% today, while his disapproval rating has risen by 12 points, from 30% to 42%. The fact that Obama’s approval on the economy has become more negative over this time period is of interest, given that Gallup’s measure of consumer mood has become more positive between March and the current time... Gallup has measured Obama’s handling of the federal budget deficit only twice — once in March and again in the current survey — and his ratings have become slightly more negative over that time. The percentage of Americans approving has dropped by three points, while the percentage disapproving has increased by four points."

State Department Official With Top Security Clearance And Wife Arrested On Spying For Cuba For The Past Three Decades
Reuters reports that "a former U.S. State Department official and his wife have been arrested for spying for the Cuban government for nearly 30 years, the Justice Department said on Friday. Walter Kendall Myers, 72, aided by his wife Gwendolyn Myers, 71, used his Top Secret security clearance to pass on classified information to the Cuban government and at one point met with Cuban leader Fidel Castro, according to court documents. The two were charged with conspiracy to act as illegal agents of the Cuban government and to communicate classified information to Cuba, the Justice Department said. They were also charged with wire fraud and acting as illegal agents. They face up to 35 years in prison." They have both pleaded not guilty.
