NY Post: Slow And Reckless Snow Cleanup In NYC Was An Irresponsible And Selfish Union "Protest" Against Budget Cuts
The NY Post reports: "These garbage men really stink. Selfish Sanitation Department bosses from the snow-slammed outer boroughs ordered their drivers to snarl the blizzard cleanup to protest budget cuts -- a disastrous move that turned streets into a minefield for emergency-services vehicles, The Post has learned. Miles of roads stretching from as north as Whitestone, Queens, to the south shore of Staten Island still remained treacherously unplowed last night because of the shameless job action, several sources and a city lawmaker said, which was over a raft of demotions, attrition and budget cuts."
"They sent a message to the rest of the city that these particular labor issues are more important," said City Councilman Dan Halloran (R-Queens), who was visited yesterday by a group of guilt-ridden sanitation workers who confessed the shameless plot.
The NY Post reports that "Halloran said he met with three plow workers from the Sanitation Department -- and two Department of Transportation supervisors who were on loan -- at his office after he was flooded with irate calls from constituents."
The snitches "didn't want to be identified because they were afraid of retaliation," Halloran said. "They were told [by supervisors] to take off routes [and] not do the plowing of some of the major arteries in a timely manner. They were told to make the mayor pay for the layoffs, the reductions in rank for the supervisors, shrinking the rolls of the rank-and-file."

Israel's Shin Bet: Iran Hamas's Top Supplier In 2010
The Jerusalem Post reports that "Iran smuggled into the Gaza Strip about 1,000 mortar shells, hundreds of short-range rockets and a few dozen advanced anti-tank missiles over the past year, the Shin Bet (Israel Security Agency) revealed on Thursday. In a report summing up 2010, the Shin Bet said that Iran continued to serve as Hamas’s main supplier of weaponry throughout the past year using smuggling routes in Sudan and the Sinai Peninsula. It was also instrumental in funding the training of Hamas operatives in Lebanon and Syria."

Top 4 Contestants For Most Stupid Local Government Decision
From Cato's Daniel J. Mitchell:
Contestant Number One is an officer of the Baltimore County Natural Resources Police, who fined two men $90 each for the vicious, horrible, nasty crime of … (please don’t faint) … rescuing a deer. Yes, your eyes do not deceive you. Two hardened criminals used an inflatable raft to free a helpless animal, but they flouted the law by not wearing life jackets. Since I already did a blog post about a man being fined for rescuing a wounded deer, I guess the moral of the story is that bureaucrats don’t like Bambi.
Contestant Number Two is the Metro Police in Washington, DC, which has decided to harass random travelers by searching their bags before they board the subway. This is akin to the TSA’s mindless bureaucracy – but even worse. There surely are nut-jobs who would like to blow up Americans, but they could do that on a bus, on a crowded street during rush hour, or any other place where a large number of people are gathered. Heck, they can drive a car into a crowd. Good intelligence by the CIA and FBI is the way to stop these crackpots, not empty security theater that makes life more difficult for law-abiding people.
Contestant Number Three is the St. Paul School District in Minnesota, which has turned all schools into “sweet-free zones.” This ban also applies to salty foods, however that is defined, and deals “a blow to booster clubs and parent organizations, too, which won’t be able to sell hot chocolate, doughnuts, candy bars and cookies at school events.” I actually agree with Michelle Obama that American kids are overweight, but I also know that government intervention isn’t going to solve the problem unless we want a police state that bans video games, TVs, computers, and the other technological developments that are responsible for sedentary kids.
Contestant Number Four is Battlefield High School, in Haymarket, VA, which disciplined 10 unrepentant gang members. What did these thugs do to warrant detention? Brace yourself and make sure no children are looking over your shoulders, because these hoodlums belong to a particularly nasty group called the Christmas Sweater Club and they got in trouble for handing out miniature candy canes. One school administrator (Mrs. Grinch?) explained that “not everyone wants Christmas cheer,” thus turning Jay Leno’s parody into reality.

Israeli Foreign Minister Avigdor Lieberman: Peace Deal Is "Impossible"
The AP reports that "Avigdor Lieberman, the Israeli foreign minister, told a conference of Israeli diplomats that instead of a full peace deal, Israel should seek a long-term, interim agreement on security and economic matters. Palestinians have consistently rejected that approach."
"It's not only that it is impossible" to reach an overall agreement, he said. "It is simply forbidden."
The AP writes that "Lieberman said the West Bank Palestinian Authority — with whom Israel has pledged to negotiate — is 'not legitimate' because it has postponed elections. Palestinian President Mahmoud Abbas remains in office though his term expired almost a year ago, and there is no date for a new election."

Obama WH Says Polar Bears Not Endangered
Politico reports that the "Obama administration is sticking with a George W. Bush-era decision to deny polar bears endangered species status. In a court filing Wednesday, the Fish and Wildlife Service defended the previous administration’s decision to give the polar bear the less-protective 'threatened' species designation, a move that will frustrate environmentalists who hoped for stronger protections under the Endangered Species Act. … At the time, the service determined the bears weren’t danger of extinction, so did not warrant the 'endangered' status. The bears were listed as 'threatened' because they face serious threats from projected decline in its sea ice habitat due to global warming would result in them likely being in danger of extinction in the foreseeable future." Gov. Chris Christie Commutes Sentence Of Man Convicted Of Having Guns In N.J. Illegally
Brian Aitken, who was convicted of illegally possessing three handguns he had legally purchased in Colorado, will be out of prison in time for Christmas. Gov. Chris Christie commuted Aitken's sentence Monday, from seven years to time served, according to an order signed by the governor. It was Christie's first commutation since taking office almost a year ago. "We are overjoyed at the news," his younger brother Robert Aitken said in an e-mail. "It's been an extremely emotional time and we all had our own doubts at one time or another I'm sure. I was hoping for the best but preparing for the worst -- for this to be the first battle of a long war to get him out of jail." In 2009, Aitken was arrested for possessing three handguns and ammunition — the guns were unloaded — after state police found them in the trunk of his car. Aitken was visiting his mother in Burlington County when she became concerned about his well-being and called the police. Tweet

GOP To Recommend The Adoption Of A Rule Requiring Lawmakers To Provide Constitutional Authority For Every Bill
The Hill reports that "Rep. Rob Bishop (R-Utah), the head of the House Rules Working Group, on Thursday said the GOP transition team will recommend the adoption of a rule requiring lawmakers to provide constitutional authority for every bill."
“The Constitution is not that long. The operating manual for a Toyota Camry is more than five times longer, so it should not be that difficult,” Bishop said.
This is a good symbolic move that will show that the GOP Congress is serious about Constitutional conservatism. However, the GOP must make clear that it is the original meaning of the Constitution's provisions that will serve as the basis for any piece of legislation passed by Congress. If this is not to serve as the basis, the Democrats will simply point to the Commerce Clause as encompassing just about everything. The Obamacare mandate makes it clear that judges and politicians have absolutely no problem stretching the Constitution passed any logical limitation. The elastic, living, evolving interpretation given to the Constitution by liberals who in reality have no loyalty to what the Constitution demands, and by Supreme Court precedent itself, makes it all too easy to abuse the Constitution by linking a piece of legislation to a provision of the Constitution that in reality was never intended to provide the basis for the bill. However, insofar as the Constitution is part of the debate in Congress and will help make it part of the public debate, it is a worthwhile effort.

"When your life hangs on the line," said Gen. James F. Amos, the commandant of the Marine Corps, "you don't want anything distracting... Mistakes and inattention or distractions cost Marines' lives."

Germany Using Anti-Nazi Laws Against Islamofascists
The Christian Science Monitor reports that "German authorities hardened a crackdown on Islamic groups yesterday, raiding homes and schools that reportedly belong to adherents of fundamentalist Salafi Islam. German officials said the preemptive raids, conducted under German anti-Nazi laws of association, were aimed at uncovering unconstitutional or separatist acts and not part of an international terror hunt. The raids targeted the Islamic Cultural Center of Bremen, on the North Sea, along with a group calling itself Invitation to Paradise in two small northwest German cities. Invitation to Paradise's leader has called for sharia, or Islamic law, to prevail one day but has specifically opposed using violence to impose it." Tweet

Georgetown Law Professor Randy Barnett Responds To Judge Hudson's Ruling Declaring Obamacare Individual Mandate Unconstitutional
Randy Barnett wrote in the New York Times:
The days of calling the constitutional challenges to the Affordable Care Act “frivolous” and “political” are now officially over. Judge Hudson’s ruling that the individual insurance mandate is unconstitutional is a milestone in the legal process of deciding whether Congress has the power to command every person in the United States to enter into an economic relationship with a private company. Until 2010, the only mandates ever imposed on American citizens pertained to their citizenship: register for the draft and serve if called, sit on a jury, file a tax return, respond to the census. In the U.S., one cannot even be commanded to vote. If economic mandates like this one are allowed, however, Americans will be demoted from citizens to subjects. They will have to obey any commands that Congress deems convenient to its regulation of interstate commerce. No more expensive tax credits and subsidies to raise taxes to pay for; Congress can just command you to buy its favored products. Forget cash for clunkers; just make Americans buy cars from G.M. Or make them undergo medical exams to save on health care costs. Gone will be a federal government of limited and enumerated powers established by the Constitution and repeatedly affirmed by the Supreme Court. In his ruling today, Judge Hudson recognized that such an unprecedented claim of power had never been sanctioned by the Supreme Court.

Virginia Federal Judge Rules Obamacare Mandate Is Unconstitutional: "Exceeds The Commerce Clause Powers Vested In Congress Under Article I"
U.S. District Judge Henry E. Hudson wrote that no court had expanded the Commerce Clause of the Constitution to allow the government to regulate a person's decision not to buy a product. "At its core, this dispute is not simply about regulating the business of insurance — or crafting a scheme of universal health insurance coverage — it's about an individual's right to choose to participate," Hudson wrote.
"The outcome of this case has significant public policy implications," Hudson wrote. "And the final word will undoubtedly reside with a higher court."
Hudson sided with Virginia Attorney General Kenneth Cuccinelli, who argued the mandate overstepped the bounds of the Constitution.
"The ruling is extremely positive for anyone who believes in the system of Federalism created by our founding fathers," Cuccinelli said. "It underscores that the Constitution's limitations on federal power really do mean something."
Judge Hudson correctly wrote that "[a] thorough survey of pertinent constitutional case law has yielded no reported decisions from any federal appellate courts extending the Commerce Clause or General Welfare Clause to encompass regulation of a person’s decision not to purchase a product, notwithstanding its effect on interstate commerce or role in a global regulatory scheme. The unchecked expansion of congressional power to the limits suggested by the Minimum Essential Coverage Provision would invite unbridled exercise of federal police powers."

Baltimore Convert To Islam Charged In Terror Plot Against Military Recruiting Center
The Washington Times reports that "Federal authorities on Wednesday charged a 21-year-old Baltimore man with participating in what he believed was a plot to detonate a car bomb outside a military recruiting center in Catonsville, Md. Antonio Martinez, who also goes by the name Muhammad Hussain and is identified in court papers as a 'recent convert to Islam,' was charged with attempted murder of federal officers/employees and attempted use of a weapon of mass destruction against U.S. property."
The Associated Press writes that the "21-year-old construction worker who had recently converted to Islam and told an FBI informant he thought about nothing but jihad... The bomb he is accused of trying to detonate was fake and had been provided by an undercover FBI agent. It was loaded into an SUV that Martinez parked in front of the recruiting center, authorities said, and an FBI informant picked him up and drove him to a nearby vantage point where he tried to set it off."

US Drops Demand For Another Israeli Settlement Freeze
The Jerusalem Post reports that the "US-led diplomatic process between Israel and the Palestinian Authority is going back to the drawing board, a senior US official announced Tuesday night. Following consultation with the sides, it was determined that a further settlement moratorium would not provide the basis for a framework agreement... The surprise announcement came nearly a month after Netanyahu and US Secretary of State Hillary Clinton agreed in principle on 90-day settlement moratorium extension in exchange for a package of incentives from Washington. Since that time the US has held intensive talks with both Israel and the PA about the precise details of the incentives and what would happen during the three months of negotiations during the freeze. What emerged, according to diplomatic officials, was a gap between what Israel thought could be achieved during this time, and Palestinian expectations. The Palestinians, according to Israeli sources, wanted the talks to focus on border issues, in the expectation that this issue would be solved within three months. Israel, however, refused to commit to this timetable, arguing that it would not talk about borders without talking about security agreements, and that it would not agree to ceding land without knowing in advance what security arrangements would be put in place when it withdrew. Among security arrangements Israel is demanding are an Israeli presence on the eastern border of a future Palestinian state, and that the future state be demilitarized. Tweet
