Democrat Governor Signs "Wyoming Firearm Freedom Act" Into Law

The AP reports that Governor "Dave Freudenthal has signed into law a bill that seeks to exempt guns made in Wyoming and used exclusively in the state from federal regulations... Although Freudenthal signed it, he expressed concerns that it could leave Wyoming firearms dealers caught between the contradictory demands of state and federal law. Montana and Tennessee have already passed similar laws and the federal government has informed gun dealers in those states that they still have to follow federal regulations. Lyman Republican Rep. Allen Jaggi was the main sponsor of the Wyoming bill. He says he sees no reason for the federal government to try to get involved in regulating guns made and sold in Wyoming."

Though the Act's title implies that it is only a bill increasing the right to own a handgun, this bill amounts to much more than that. It specifically is meant to bolster the Second Amendment at the same time as it counters the interpretation of the Commerce Clause (article 1, section 8, clause 3 of the United States Constitution) by the Supreme Court that for the most part presumptively allows Congress to pass all sorts of federal legislation. The Act states in part, "A personal firearm, a firearm accessory or ammunition that is manufactured commercially or privately in Wyoming and that remains exclusively within the borders of Wyoming is not subject to federal law, federal taxation or federal regulation, including registration, under the authority of the United States congress to regulate interstate commerce. It is declared by the Wyoming legislature that those items have not traveled in interstate commerce. This section applies to a firearm, a firearm accessory or ammunition that is manufactured in Wyoming from basic materials and that can be manufactured without the inclusion of any significant parts imported from another state or foreign country." The Act also explains that "[t]he regulation of intrastate commerce is vested in the states under the ninth and tenth amendments to the United States constitution, particularly if not expressly preempted by federal law pursuant to article 1, section 8 of the United States constitution. The United States congress has not expressly preempted state regulation of intrastate commerce pertaining to the manufacture on an intrastate basis of firearms, firearms accessories and ammunition."

Conservative Victory In Texas Textbook Wars

The Houston Chronicle reports that the "State Board of Education tentatively approved new standards for social studies today with members divided along party lines — some blasting the standards as a 'fraud on the students of this state' and others praising them as a tribute to the Founding Fathers and a portrayal of 'an exceptional country.' The new standards face a public hearing and a final board vote in May. They will influence new history and government public school textbooks starting in the 2011-12 school year. Democrat members — all minorities — complained the new standards unfairly dilute Hispanic contributions to Texas and U.S. history.

Republican Terri Leo called the proposed standards “a world class document” and told her Democratic colleagues the board has “included more minorities and historical events than ever before. ... I am very disappointed at those allegations because they are simply not true.”

Ken Mercer, R-San Antonio, said the proposed standards reflect the desires of his constituents to emphasize “personal responsibility and accountability” and “to honor our Founding Fathers, and we want to honor our military.”

Federal Appeals Court In San Francisco Upholds Constitutionality Of The Use Of "Under God" In The Pledge And "In God We Trust" On Money

The AP reports that a "federal appeals court in San Francisco upheld the use of the words 'under God' in the Pledge of Allegiance and 'In God We Trust' on U.S. currency, rejecting arguments on Thursday that the phrases violate the" Establishment Clause. The AP writes that the "9th U.S. Circuit Court of Appeals panel rejected two legal challenges by Sacramento atheist Michael Newdow, who claimed the references to God disrespect his religious beliefs... The same court ruled in Newdow's favor in 2002 after he sued his daughter's school district for having students recite the pledge at school. That lawsuit reached the U.S. Supreme Court in 2004, but the high court ruled that Newdow lacked the legal standing to file the suit because he didn't have custody of his daughter, on whose behalf he brought the case. So Newdow, who is a doctor and lawyer, filed an identical challenge on behalf of other parents who objected to the recitation of the pledge at school. In 2005, a federal judge in Sacramento decided in Newdow's favor, ruling that the pledge was unconstitutional... In a separate 3-0 ruling Thursday, the appeals court upheld the inscription of the national motto 'In God We Trust' on coins and currency, saying that the phrase is ceremonial and patriotic, not religious."

"The Pledge is constitutional," Judge Carlos Bea wrote for the majority in the 2-1 ruling. "The Pledge of Allegiance serves to unite our vast nation through the proud recitation of some of the ideals upon which our Republic was founded."

I applaud the Court's decision and its return from the edge of madness to sanity in declaring that "under God" in the Pledge of Allegiance and "In God We Trust" on U.S. currency is constitutional. But the reasoning as provided by the Associated Press that "the phrase is ceremonial and patriotic, not religious" is nothing short of ridiculous. It is the sort of reasoning that forces courts, regardless of reality, to declare what they wish to uphold non-religious and what they wish to strike down religious. I only wish courts would return to jurisprudence that reflects the original meaning of the First Amendment's Establishment Clause. Justice William Rehnquist explained in his very important 1985 dissent in Wallace v. Jaffree that "it seems indisputable from... [James] Madison's thinking, as reflected by actions on the floor of the House in 1789, that he saw the [First] Amendment as designed to prohibit the establishment of a national religion, and perhaps to prevent discrimination among sects. He did not see it as requiring neutrality on the part of government between religion and irreligion." Madison is the "Father of the Bill of Rights" because he is largely responsible for the first ten amendments to the Constitution. The Annals of Congress, formally known as The Debates and Proceedings in the Congress of the United States, spans from 1789 to 1824 as it covers the 1st Congress through the first session of the 18th Congress. The Annals quote James Madison as having apprehended the words of the First Amendment to mean simply that "that Congress should not establish a religion, and enforce the legal observation of it by law, nor compel men to worship God in any manner contrary to their conscience." Harvard Law Professor Laurence Tribe states that "[a] growing body of evidence suggests that the Framers principally intended the Establishment of Religion Clause to perform two functions: to protect state religious establishments from national displacement, and to prevent the national government from aiding some, but not all, religions." Using Madison's simple test from the Annals, Establishment Clause jurisprudence should be very simple, and "Under God" and "In God We Trust" would clearly be constitutional. As Rehnquist succintly put it in his dissenting opinion, "It is impossible to build sound constitutional doctrine upon a mistaken understanding of constitutional history."

Justice Clarence Thomas correctly said in his 2005 concurrence in Van Orden v. Perry, one of the Ten Commandment monument cases, that "[m]uch, if not all, of this would be avoided if the Court would return to the views of the Framers and adopt coercion as the touchstone for our Establishment Clause inquiry. Every acknowledgment of religion would not give rise to an Establishment Clause claim. Courts would not act as theological commissions, judging the meaning of religious matters. Most important, our precedent would be capable of consistent and coherent application."

Further, Justice Antonin Scalia wittingly noted in his 1992 concurrence in Lamb's Chapel v. Center Moriches Union Free School District: "What a strange notion, that a Constitution which itself gives 'religion in general' preferential treatment (I refer to the Free Exercise Clause) forbids endorsement of religion in general." He further wrote in his Lee v. Weisman dissent that "[o]ur religion clause jurisprudence has become bedeviled (so to speak) by reliance on formulaic abstractions that are not derived from, but positively conflict with, our long accepted constitutional traditions."

As a Supreme Court majority itself in the 1952 case of Zorach v. Clauson declared, "We are a religious people whose institutions presuppose a Supreme Being."

Those that are angry at Walmart simply have no basic understanding of how prices are determined in a free market. They are ignorantly talking about "ugly inequalities" as if the prices of the Barbie dolls are being determined by Bull Connor. In reality, the lowered price does not reflect the intrinsic value of the product. As anyone with even a basic understanding of economics knows, it is a reflection of supply and demand. The supply of black Barbies at the store exceeded demand for that Barbie. Lowering the price was the rational response to market conditions in order to meet the realities at the store. Those that think this is controversial seem not to realize that if the price of the black Barbie did not decrease, it would simply stay stocked on the shelves rather than getting sold as the new inventory arrives. A self-imposed price control based on racial sensitivity, artificially keeping the prices of black Barbie dolls at the higher price of white Barbies despite the lower demand, would simply result in a black Barbie surplus. As Thomas Sowell explains, "a chronic surplus of the same thing...means that somebody is preventing the price from falling. Otherwise the excess supply would drive down the price, leading producers to produce less -- and consumers to consume more -- until the surplus was gone... People with a basic knowledge of economics would understand that words like 'surplus' and 'shortage' imply another word that may not be mentioned explicitly: Price. And chronic surpluses or chronic shortages imply price controls. Conversely, price controls imply chronic surpluses or shortages -- depending on whether price controls keep prices from falling to the level they would reach under supply and demand or keep them from rising to that level."

The fallacy that prices reflect intrinsic value is based on misunderstandings of how prices are determined. For example, often one hears that it is a scandal that a man can make millions of dollars for throwing a baseball really fast while the wages of America's teachers are far too low. This is another example of the misguided view that prices somehow reflect moral worth or reflect the values of our society. However, this is based on the lack of realization that wages are essentially the price at which one sells his labor and therefore the wage is determined by the market through supply and demand. The reason that the ball player makes millions is because the supply is very limited, as the skill necessary to be a great pitcher is limited, and the demand is very high by baseball clubs which are in turn able to utilize the great pitcher to attract more people to the stadiums and to their televisions to watch games. On the other hand, the supply of those with the skills necessary to teach public elementary schools is not limited at all. Therefore, the elementary school teacher, who may be doing something more valuable every day than the ball player, will earn a much lower wage. The principle applies as equally to Barbie dolls as it does to wages.

GOP Gets House Vote Which Pressures The Ethics Panel To Probe Democrat Leaders On What They Knew About Massa

The Hill reports that the "House voted Thursday to have the ethics panel consider an investigation into what Democratic leaders knew of allegations of sexual harassment against former Rep. Eric Massa (D-N.Y.). Only two members cast votes against the resolution, which came up after GOP Leader John Boehner (Ohio) offered a privileged resolution to ask ethics to open an investigation. Boehner immediately hailed the vote as sending a strong bipartisan signal that an investigation is necessary to answer "serious questions" about the Massa matter. 'We all have a responsibility to rise above politics and do what's right for the institution of the House,' Boehner said. Boehner's resolution asks that the ethics panel look into what House Speaker Nancy Pelosi (D-Calif.), House Majority Leader Steny Hoyer (D-Md.) and other Democratic leaders and staffers knew about allegations of sexual harassment against Massa, and when they became aware of the situation."

Holder Under Fire For Padilla Brief

Politico reports that conservative "critics of Attorney General Eric Holder’s handling of accused terrorists found a new issue on which to criticize him Wednesday – an amicus brief Holder signed on to urging the Supreme Court in 2004 to reject the Bush administration’s attempt to try Jose Padilla as an enemy combatant. Two former Bush administration officials said the brief’s acknowledgement that accused terrorists could go free if their cases were heard through the normal judicial process contradicted Holder’s public statements justifying the FBI’s reading Umar Farouk Abdulmutallab, the alleged underwear bomber, his Miranda rights. They also pointed out that Holder had not called the brief to the attention of the Senate Judiciary Committee during his confirmation hearings... Padilla, a U.S. citizen, sued after he was held without charge as an enemy combatant. The Bush administration eventually dropped its attempt to try him as an enemy combatant and Padilla was eventually tried and convicted in civilian court. He is now serving a 17-year sentence in a Supermax prison. Holder didn’t mention the brief during his confirmation hearings to be Attorney General, even though the Senate Judiciary Committee questionnaire required him to list all Supreme Court amicus briefs he was party to. His questionnaire lists briefs in only three cases: Miller-El v. Cockrell, Johnson v. Bush and D.C. and Fenty v. Heller."

“Now that Holder is attorney general, he no longer acknowledges the risks to national security of treating terrorists as criminals,” the two former Bush officials, Bill Burck, a former deputy White House counsel, and Dana Perino, the former White House Press Secretary, wrote. “Holder could never admit that now, of course.”

A British Airways Employee Charged With Preparing To Commit Terrorism And Funding It

CNN reports that a "British Airways employee appeared in court Thursday on charges of preparing to commit terrorism and funding it. Rajib Karim, 30, is charged with two counts of engaging in conduct in preparation of terrorist acts and fundraising for the purpose of terrorism, London's Metropolitan Police Service said Wednesday. He appeared in Westminster Magistrates' Court on Thursday. Karim, of Newcastle-upon-Tyne, is an information technology developer for British Airways, authorities have said. The alleged offenses took place between April 13, 2006, and February 25, 2010, 'with the intention of committing acts of terrorism outside the UK or assisting another to commit such acts,' police said. Authorities said Karim -- who was born in Bangladesh and is now a British citizen -- collected money in Britain and sent it to Yemen and Bangladesh to fund terrorist activities. British authorities believe he had significant success in financing terrorist operations, security sources with knowledge of the case told CNN. He volunteered to recruit suicide bombers and to be one himself, prosecutors said in court. He said he would go to Yemen or Pakistan for training, they charged. Karim did not speak during the 15-minute court hearing except to confirm his name. He did not enter a plea and did not apply for bail. Police learned about his alleged activities from encrypted data on his computer at home, which was seized when he was arrested last month. He used his position at British Airways to advise foreign terrorists on airport security measures, including suspicion scans, liquid allowances, and computer systems, prosecutors alleged. He is also accused of offering to take advantage of a possible strike by British Airways crews to move into a temporary position where he could be of help to terrorists. BA is planning to shuffle staff to cover positions left vacant if the strike goes ahead."

New York Nanny State Law Proposes To Ban Salt In Restaurant Cooking Or For Restaurant Customers

Fox NY reports that some "New York City chefs and restaurant owners are taking aim at a bill introduced in the New York Legislature that, if passed, would ban the use of salt in restaurant cooking... The legislation, which Assemblyman Felix Ortiz , D-Brooklyn, introduced on March 5, would fine restaurants $1,000 for each violation."

"No owner or operator of a restaurant in this state shall use salt in any form in the preparation of any food for consumption by customers of such restaurant, including food prepared to be consumed on the premises of such restaurant or off of such premises," the bill, A. 10129, states in part.

New York chefs are reacting to this ridiculously paternalistic law. "The consumer needs to make their own health choices. Just as doctors and the occasional visit to a hospital can't truly control how a person chooses to maintain their health, neither can chefs nor the occasional visit to a restaurant," said Jeff Nathan, the executive chef and co-owner of Abigael's on Broadway. "Modifying trans fats and sodium intake needs to be home based for optimal health. Regulating restaurants will not solve this health issue."

"Chefs would be handcuffed in their food preparation, and many are already in open rebellion over this legislation," said Orit Sklar, of My Food My Choice, which calls itself a coalition of chefs, restaurant owners, and consumers. "Ortiz and fellow anti-salt zealot Mayor Michael Bloomberg of New York City seek to undermine the food and restaurant business in the entire state." My Food My Choice called the proposed law "absurd" in a press release issued on its Facebook page.

The AP reports that "U.S. Supreme Court Chief Justice John Roberts said Tuesday the scene at President Obama's State of the Union address was 'very troubling' and the annual speech has 'degenerated to a political pep rally.' Obama chided the court, with the justices seated before him in their black robes, for its decision on a campaign finance case. Responding to a University of Alabama law student's question, Roberts said anyone was free to criticize the court, and some have an obligation to do so because of their positions."

"So I have no problems with that," he said. "On the other hand, there is the issue of the setting, the circumstances and the decorum. The image of having the members of one branch of government standing up, literally surrounding the Supreme Court, cheering and hollering while the court — according the requirements of protocol — has to sit there expressionless, I think is very troubling."

"I'm not sure why we're there," said Roberts, a Republican nominee who joined the court in 2005.

Supreme Court To Rule On Free Speech In Case Of Protest Against Soldier's Funeral

The L.A. Times reports that the "Supreme Court agreed Monday to decide on the outer limits of free-speech protection for public protests and to rule on whether a dead soldier’s family can sue fringe religious protesters who picketed near their son’s funeral with signs that said, 'Thank God for dead soldiers.' A Maryland jury awarded $10 million in damages to Albert Snyder, whose son Matthew was killed in Iraq in March 2006. He had sued Fred Phelps, the founder of the Westboro Baptist Church in Topeka, Kan., who has traveled the country for 20 years leading controversial protests at funerals for American soldiers. He claims that God hates America because of its tolerance of homosexuality. He and his small group of followers carried protest signs at the funeral in Westminster, Md., that said, 'Fag troops,' 'God hates the USA' and 'God hates fags.' But a lawyer for Phelps said his protests were not targeted at Lance Corp. Matthew Snyder, the soldier, but more generally at America and the U.S. military. The protesters were kept at a distance from the church and the burial service. Nonetheless, the jury awarded damages to the Snyder family on the grounds that the funeral protests invaded their privacy and intentionally inflicted emotional distress."

In September, however, the U.S. 4th Circuit Court of Appeals threw out the entire award on free-speech grounds. “Notwithstanding the distasteful and repugnant nature of the words being challenged in these proceedings, we are constrained to concluded that the defendants’ signs are constitutionally protected,” the appeals court said.

Israeli Ambassador Michael Oren Offers To Return To UCI To Talk With Hecklers

The AP reports that "Israeli Ambassador Michael Oren has offered to return to the University of California, Irvine to exchange views with students who heckled him raucously on campus last month. Oren made the offer in an open letter to the UC Irvine community published Monday on the Web site of the campus newspaper New University." The hecklers yelled things such as "murderer," "war criminal," and "genocide."

Anti-Israel Muslim Activist Attacks Jewish Girl On UC Berkeley Campus

Israel National News reports that "University of California at Berkeley was again the site of a clash involving pro-Israel and anti-Israel activists last Friday when Husam Zakharia, leader of the Students for Justice in Palestine, assaulted Jessica Felber of the pro-Israel Tikvah group with a shopping cart. The incident occurred during competing events from the SJP-run “Israel Apartheid Week” and “Israel Peace and Diversity Week” organized by Tikvah. Felber was holding a sign that read “Israel Wants Peace” when Zakharia intentionally slammed her from behind with a shopping cart filled with toys donated for the welfare of Arab children in the Hamas-controlled Gaza region. Felber told Israel National News that she responded to the incident by immediately placing her attacker under citizens’ arrest. Police arrested him later that day and Felber expressed hope that the District Attorney will see the case through and file charges against Zakharia."

Truther Ahmadenijad: 9-11 Is A "Big Fabrication"

Reuters reports that "Iranian President Mahmoud Ahmadinejad on Saturday called the September 11 attacks on the United States a "big fabrication" that was used to justify the U.S. war on terrorism, the official IRNA news agency reported. Ahmadinejad, who often rails against the West and Israel, made the comment in a meeting with Intelligence Ministry personnel. It came amid escalating tension in the long-running dispute between Iran and the West over Tehran's nuclear program, with the United States pushing for new U.N. sanctions against the major oil producer. Ahmadinejad described the destruction of the twin towers in New York on September 11, 2001 as a 'complicated intelligence scenario and act,' IRNA reported."

He added: "The September 11 incident was a big fabrication as a pretext for the campaign against terrorism and a prelude for staging an invasion against Afghanistan."

Orange County Republican Politicians Urge Strict Punishment From UCI Against Hecklers Of Israeli Ambassador Michael Oren

The Jewish Journal reports that two "Orange County elected officials have joined calls for administrators at the University of California, Irvine (UCI) to act decisively against students involved in provocative, anti-Israel activity. In separate letters to UCI Chancellor Michael Drake, Rep. John Campbell (R-Calif.) and state Assemblyman Chuck DeVore (R-Irvine) called for strict discipline against students for repeated heckling of Michael Oren, Israel’s ambassador to the United States, during a Feb. 8 speech at the Student Center. Eight UCI students, including the president of the UCI’s Muslim Student Union (MSU), were arrested and charged with violating the university’s student code of conduct. In a Feb. 26 letter to UCI Chancellor Michael Drake, Rep. John Campbell (R-Calif.) urged full disciplinary action be taken against those students responsible for the incident, describing their behavior as 'egregious' and 'intolerable.' He also called for an investigation into the conduct and membership of the MSU. 'This is not the first time the MSU has been involved in violations of free speech, intimidation, and, at the very least, threats of violence on campus. Sadly, this is becoming a pattern, and one which is especially troubling, as the chosen rhetoric of this group incites hate and violence against both this country and Jewish-American students on campus,' Campbell wrote. Muslim students and their defenders claim they were exercising their right to free speech when they interrupted Oren with shouts like 'You are an accomplice to genocide' a total of 10 times before dozens of students boisterously left the ballroom to stage a demonstration outside. Experts, including UCI Law School Dean Erwin Chemerinsky and civil liberties scholar Nat Hentoff, maintain that the students’ actions are not protected under the First Amendment... DeVore’s Feb. 23 letter calls on Drake to ban the MSU as 'an entity inimical to the University’s imperative to provide an education in an atmosphere of academic liberty, free of coercion and conducive to meaningful debate and free inquiry.' The assemblyman said he recognized this step to be a 'severe and enduring penalty,' but that the MSU’s dedication 'to support of terrorism, anti-Semitism and the suppression of free speech' warranted such a response. Representatives for Campbell and DeVore said neither official has yet to hear back from Drake on this matter."

American-Born Al Qaeda Spokesman Adam Gadahn Captured In Pakistan

The AP reports that the "American-born spokesman for al-Qaida has been arrested by Pakistani intelligence officers in the southern city of Karachi, two officers and a government official said Sunday, the same day Adam Gadahn appeared in a video urging U.S. Muslims to attack their own country. The arrest of Gadahn is a major victory in the U.S.-led battle against al-Qaida and will be taken as a sign that Pakistan is cooperating more fully with Washington. It follows the recent detentions of several Afghan Taliban commanders in Karachi. Gadahn — who has often appeared in al-Qaida videos — was arrested in the sprawling southern metropolis in recent days, two officers who took part in the operation said. A senior government official also confirmed the arrest."
