2nd Circuit Court Of Appeals Rules Against FCC Policies As Violating The First Amendment Because They Are "Unconstitutionally Vague"

The Washington Post reports that the U.S. Court of Appeals for the 2nd Circuit said the FCC's "rules on indecency are too vague and violate the First Amendment, undermining the government's primary tool for policing civility over the airwaves. With its decision, the three-judge panel handed a victory to broadcasters such as Fox, CBS and ABC, which had petitioned the court to challenge the agency's muscled-up approach of imposing steep fines for impromptu expletives and sexual content. Broadcasters had taken their arguments against the FCC's policy to the Supreme Court, which ruled in favor of the agency April 29. It said the FCC followed administrative procedure, but it did not address whether the rules were constitutional -- an issue it sent to the appeals court. On Tuesday, the appeals judges called the FCC's policy, in place since 2004, 'unconstitutionally vague, creating a chilling effect that goes far beyond the fleeting expletives at issue here.' The vagueness left broadcasters uncertain about what they could air, which impinged on their freedom of speech, the judges said."

Dodd-Frank "Financial Reform" Bill Includes Racial And Gender Quotas

The recently passed "Dodd-Frank financial regulatory bill, ostensibly aimed at reforming Wall Street and preventing a future financial crisis, will impose racial and gender quotas on financial institutions... Section 342 of the bill will establish Offices of Minority and Women Inclusion in at least 20 federal financial services agencies. These offices will be tasked with implementing 'standards and procedures to ensure, to the maximum extent possible, the fair inclusion and utilization of minorities, women, and minority-owned and women-owned businesses in all business and activities of the agency at all levels, including in procurement, insurance, and all types of contracts.' So called 'fair inclusion' will apply to 'financial institutions, investment banking firms, mortgage banking firms, asset management firms, brokers, dealers, financial services entities, underwriters, accountants, investment consultants and providers of legal services.'The provision goes on to assert that the government will terminate contracts with institutions they deem have 'failed to make a good faith effort to include minorities and women in their workforce.'"

Federal Court Says That Law Prohibiting Falsely Claiming To Be A Military Hero Is Unconstitutional As It Violates The First Amendment's Free Speech

The AP reports that a "law that makes it illegal to lie about being a war hero is unconstitutional because it violates free speech, a federal judge ruled Friday as he dismissed a case against a Colorado man who claimed he received two military medals. Rick Glen Strandlof claimed he was an ex-Marine who was wounded in Iraq and received the Purple Heart and Silver Star, but the military had no record he ever served. He was charged with violating the Stolen Valor Act, which makes it a crime punishable by up to a year in jail to falsely claim to have won a military medal. U.S. District Judge Robert Blackburn dismissed the case and said the law is unconstitutional, ruling the government did not show it has a compelling reason to restrict that type of statement."

CNSNews.com reports that if "you want proof that President Obama's Executive Order on taxpayer-funded abortion was a sham, look no further than Pennsylvania, says House Republican Leader John Boehner (Ohio). Boehner and other Republicans point to reports that the Health and Human Services Department is giving Pennsylvania $160 million to set up a new high-risk insurance pool that will cover any abortion that is legal in the state."

"The fact that the high-risk pool insurance program in Pennsylvania will use federal taxpayer dollars to fund abortions is unconscionable," Boehner said in a statement on Tuesday.
