Yale Law Professor Akhil Amar vs. University Of Montana Law Professor Rob Natelson On Whether Obamacare Is "Clearly Constitutional"
Yale law professor Akhil Reed Amar argued in a Los Angeles Times op-ed that Obamacare and its individual mandates forcing citizens to purchase health insurance is "clearly constitutional." To read that article visit http://articles.latimes.com/2010/jan/20/opinion/la-oe-amar20-2010jan20.
Unfortunately for Mr. Amar, University of Montana law professor Rob Natelson decided to take him apart piece by piece: http://www.tenthamendmentcenter.com/2010/01/23/on-the-constitution-beware-the-word-clearly/.

Senator Jim Demint Offers Bill To Remove Federal Funding From NPR
CBS News reports that "conservative Republican Senator Jim DeMint of South Carolina today announced plans to introduce legislation stripping federal funding from National Public Radio and the Public Broadcasting Service. The move comes following the firing of NPR contributor Juan Williams for comments about Muslims. Williams said among other things that he gets 'nervous' when he sees Muslims on his airplane flights. The firing prompted calls from Sarah Palin, Mike Huckabee and others on the right to strip NPR of funding, and now DeMint, who is beloved in the Tea Party movement despite his Senate perch, has taken up the call... The release said U.S. Rep. Doug Lamborn, a California Republican, is putting forth legislation matching DeMint's in the House. He previously put forth such legislation in June. If Republicans take control of the House in the midterm elections they could bring the matter to a vote in the next Congress. (The same is true in the Senate, though a GOP takeover there is less likely.)" Tweet

Sons Told By Doctor That Mother Was "Very Certainly Clinically Dead" Refuse To Pull The Plug, Mom Awakens From Coma 14 Hours Later
Discovery News reports that a "woman pronounced 'very certainly clinically dead' at a French hospital woke up hours later after her sons refused to turn off her life-support system, medics and the woman said. Doctors were preparing cancer patient Lydie Paillard, 60, for a chemotherapy session when she passed out, the director of the Bordeaux Rive Droite private hospital Yves Noel told AFP on Wednesday. A doctor managed to resuscitate her and put her on a ventilator but then, having consulted other doctors, called Paillard's sons to break the news that their mother was 'very certainly clinically dead.' But her sons would not turn off the respirator and she was then transferred to the university hospital of the southwestern French city where a scan revealed that she was in fact not brain dead, Noel said. 'It's a kind of miracle,' he said of Paillard, who woke up after 14 hours. He said that the doctor who resuscitated her had committed a communication error not a medical one as 'he saved her life.'"
"All I remember is that I felt unwell after receiving an injection to prevent me vomiting," Paillard told AFP by telephone from hospital where she said she felt "more tired than usual" after her ordeal.
"My sons, whom I saw yesterday, explained to me that the hospital wanted to turn off the life support system because it was over and as they refused, I was taken to the university hospital," Paillard explained. "I haven't really realized what's happened but I think my three sons are the most shocked."

9th Circuit Court Of Appeals Reinstitutes "Don't Ask, Don't Tell" Pending Appeal
Fox News reports that a "federal appeals court says the military should keep in place its 'don't ask, don't tell' policy for now. The 9th U.S. Circuit Court of Appeals on Wednesday granted the Obama administration's request for a temporary freeze of a California-based federal judge's order telling the military to stop enforcing the policy. The 1993 law says gays may serve but only if they keep secret their sexual orientation. Government lawyers sought to suspend the ruling while appeals were pending, arguing that it would pose a major problem for the military. They said it could encourage service members to reveal their sexual orientation before the issue is fully decided." Tweet

Judge Refuses To Stay Order Abolishing "Don't Ask, Don't Tell," Tells Military To Begin Accepting Gay Applicants
The AP reports that "the military is accepting openly gay recruits for the first time in the nation's history, even as it tries in the courts to slow the movement to abolish its 'don't ask, don't tell' policy. At least two service members discharged for being gay began the process to re-enlist after the Pentagon's Tuesday announcement. A federal judge in California who overturned the 17-year policy last week rejected the government's latest effort on Tuesday to halt her order telling the military to stop enforcing the law. Government lawyers will likely appeal. With the recruiting announcement, the barriers built by an institution long resistant and sometimes hostile to gays had come down. The movement to overturn the 1993 Clinton-era law gained speed when President Barack Obama campaigned on its repeal. The effort stalled in Congress this fall, and found new life last month when U.S. District Judge Virginia Phillips declared it unconstitutional." Tweet

Attorney General Holder Promises To "Vigorously Enforce" Federal Drug Laws On Marijuana If California Voters Legalize Pot In Prop 19
The Wall Street Journal reports that "Attorney General Eric Holder said the Obama administration 'strongly opposes' a California ballot measure to legalize marijuana, warning that federal drug-enforcement efforts would be 'greatly complicated' if the measure passes. Recent polls indicate voters narrowly favor passing the Regulate, Control and Tax Cannabis Act, also known as Proposition 19, in next month's election. If passed, the measure would only affect state law, leaving intact the federal law that classifies marijuana as a controlled substance alongside cocaine and other drugs. Mr. Holder said in a letter Wednesday to nine former Drug Enforcement Administration chiefs that the administration would continue to enforce federal law if California legalizes marijuana. The DEA chiefs had urged him to speak out on the matter. The ballot measure would block state police officers from seizing marijuana that complies with state law. That would be a 'significant impediment' for federal agents, Mr. Holder wrote, because the federal government typically works with local law enforcement when carrying out marijuana and other drug busts... Joseph McNamara, a retired San Jose police chief and supporter of Proposition 19, said in response to Mr. Holder's letter that efforts to block marijuana use 'waste billions of dollars' and are the wrong priority "in the midst of a sagging economic recovery."" Obama On Coming Republican Victories In November: "The Empire Is Striking Back"
To see for yourself visit http://www.realclearpolitics.com/video/2010/10/17/obama_on_gop_the_empire_is_striking_back.html. Apparently Obama would have his audience believe that Republicans are somehow controlled by some dark empire of special interests that the Democrats are immune from. The Star Wars reference is cute, but perhaps the more accurate lesson Obama should take from this election can be seen in the words of Yoda in that film when he said "you must unlearn what you have learned."
