In part, Congressman Lewis says that the Obamacare mandate is covered under the preamble which provides for the "pursuit of happiness." This is not in the Constitution's preamble, nor is it anywhere else in the Constitution of the United States. These words were in the Declaration of Independence as one of the inalienable rights that man is endowed with by the Creator, not by any government. It is not a Constitutional provision and therefore cannot be the Constitutional basis for Obamacare. This simple mistake only demonstrates the Congressman's complete ignorance of our Constitution which he took an oath to uphold.
He also cites the 14th Amendment's Equal Protection Clause without explaining how any equal protection issue is implicated. It is completely beyond me how that provision at all applies to Obamacare, and the fact is the Congressman probably had no idea what he was talking about either.
