Ohio Supreme Court Justice Working To Overturn Death Penalty Law He Had Written As A Legislator

Since when did judges, including those on the highest bench state and federal, start thinking it is their job to overturn laws (even laws they had previously written as legislators) because it "makes no sense to me at this point"? This is another perfect example of our malfunctioning judiciary.
